TERMS OF BUSINESS

1. Booking and Confirmation:

To secure a booking, the client must provide a non-refundable deposit of 15% of the agreed event cost, at a minimum cap of £50. The booking will only be considered confirmed once the deposit is received and cleared. For bookings of more that 1 performance, the 15% deposit is evenly distributed across each performance booked. The remaining balance per performance will be billed after each performance, subject to payment terms below.

2. Performance Details:

The client must provide accurate and detailed performance information, including the date, time, dress code and location of the event, as well as any specific requirements or preferences for the performance. Any other obligation or terms which the magician must adhere to by any other associated party related to the event must be communicated within 7 days of the event.

Any changes to the performance details must be communicated and agreed upon in writing at least 7 days prior to the event.

3. Performance Fees:

The performance fee will be per hour of attendance at the event, where the rate is agreed prior to booking. A fixed fee for the day may be agreed based on the nature of the event. The magician will arrive 20 minutes early, free of charge, if the parties agree an event briefing is required.

In the event that the magician is requested to attend the event for additional time during the event, this will be charged at an hourly rate prorated to each 30 mins. The total performance fee will be calculated based on the number of hours of attendance at the event.

4. Payment Terms

Where a fixed fee for the event is agreed, the balance of the performance fees and any additional charges must be paid in full 3 days prior to the event date (with the event date being day 3). If the full balance is not received within 3 days of the event, the event will be assumed cancelled by the client and subject to Term 6 "Cancellation, Postponement and Refunds". Where an hourly rate is agreed, final invoice will be issued within 7 days of event date and will be payable within 30 days after the event date.

5. Mileage Charges:

In addition to the performance fees, the client may be charged mileage at a rate of 45p per mile for travel to and from the event venue.

The mileage charges will be calculated based on the round trip distance between the magician's location and the event venue based on PostCode lookup.

6. Cancellation, Postponement and Refunds:

In the event of a cancellation or postponement by the client, the non-refundable deposit will be retained by the magician as compensation for lost opportunities.

If the event is cancelled within 7 days of the scheduled performance, and any expenses related to the event have been incurred, the client will be responsible for covering those expenses in addition to the non-refundable deposit.

The magician may exercise discretion to refuse performance and/or attendance under the following circumstances:

a. Aggressive or inappropriate behaviour exhibited by spectators or guests of the client,

b. Poor quality floor or areas next to open water

c. Unauthorised filming

When services are terminated for the above reasons, the full balance of quoted services will be payable by the client. In addition, the client will be liable to pay for any incurred expenses by the magician to that point.

7. Illness or Unforeseen Circumstances:

In the unlikely event of the magician being unable to perform due to illness or unforeseen circumstances, the client will be notified as soon as possible. The magician will make every effort to find a suitable replacement or reschedule the performance at a mutually agreed-upon date and time. If no suitable alternative is agreed, the non-refundable deposit would be returned. 

8. Client's Responsibilities:

The client is responsible for ensuring that the performance venue meets all health and safety requirements for the event.

The client shall provide adequate lighting, sound, and other necessary facilities for the performance. The client shall ensure that there is a designated area for the magician's setup and performance.

9. Intellectual Property:

The magician retains all intellectual property rights to their performance, including any original routines, scripts, or presentations.

The client agrees not to record, reproduce, or distribute the magician's performance without prior written consent.

10. Liability:

The magician will take all reasonable precautions to ensure the safety of the audience during the performance. The magician shall not be held liable for any injury, loss, or damage to property during the event. Alex Catton maintains public liability insurance coverage up to £10,000,000. A copy of insurance certificate may be provided on request.

11. Photography and Promotion:

The client agrees that the magician may use photographs or videos taken during the performance for promotional purposes unless otherwise agreed upon in writing.

12. Governing Law:

This agreement shall be governed by and construed in accordance with the laws of England and Wales.
